This agreement (“Agreement”) is entered into by and between the individual or entity (“Client”) utilizing the consultancy services and tools provided by PowerSeller.AI (the “Company”) and Eva Retail Private Limited. This Agreement shall govern the relationship between the Client and the Company and the provision of services by the Company to the Client.

PowerSeller.AI will provide a range of digital services as detailed on our website. All fees must be paid in full prior to the commencement of any campaign.

Services

PowerSeller.AI Services will include (but are not limited to):

  • Acquiring “backlinks” from other websites, blogs, and directories to generate link popularity.
  • Creating content and visual assets.
  • Preparing placement and submission reports.

Client Acknowledgment

The Client must acknowledge the following with respect to the services:

  • All fees are non-refundable.
  • All fees, services, documents, recommendations, and reports are confidential.
  • PowerSeller.AI has no control over the policies of search engines concerning the types of sites and/or content they accept currently or in the future. The Client’s website might be excluded from any directory or search engine at any time at the sole discretion of the search engine or directory.
  • PowerSeller.AI does not have control over website and blog owners removing links and content, or deleting/moving/changing their website. These placements will not be refunded or replaced.
  • Under no circumstances shall PowerSeller.AI be liable to you (the end user) for any damages whatsoever, including (without limitation) any direct incidental or consequential damages, loss of profits, or any claims of yours or third party websites. You, the end user, assume all risks and potential damages (known or unknown) associated with using PowerSeller.AI services.
  • PowerSeller.AI reserves the right to adjust anchor text and other order details to ensure successful placements or completion of services.
  • As a provider of specialized SEO services, PowerSeller.AI does not guarantee specific search engine positions for any keyword, phrase, or search term. Neither does PowerSeller.AI guarantee any traffic increases.
  • Linking to “bad neighborhoods” or obtaining links from “link farms” can seriously undermine all SEO efforts. PowerSeller.AI does not assume liability for the Client’s choice to link to or obtain a link from any particular website without prior consultation.
  • PowerSeller.AI is not responsible for changes made to the website by other parties that adversely affect the search engine rankings of the Client’s website.

Non-Disclosure

PowerSeller.AI treats all client data with complete Non-Disclosure respect. While we do not sign individual NDAs for every client that uses our services, you can be assured that we treat every client with utmost confidentiality.

We promise not to disclose any confidential information to any third party [except to our employees and professional advisors] who need to know the same for service delivery.

Restrictions

PowerSeller.AI reserves the right to cancel any orders placed for websites in illegal or offensive industries. Any content, products, services, or items hateful, objectionable or defamatory aimed at any people group, race, gender, sexual orientation, or any attacks on any person, business, organization, product, or service; cruelty towards animals; or any other content found objectionable will be cancelled and refunded.

Prescription drugs, gambling, casinos, and adult content orders MAY be possible but must be treated separately and will be cancelled and refunded if ordered through the typical online order forms.

Emails

By joining, you agree to receive emails from PowerSeller.AI, which may include order notifications, system updates, new services, offers, or educational material.

Jurisdiction

All Parties irrevocably agree that the courts of the jurisdiction where PowerSeller.AI is headquartered have the exclusive jurisdiction to:

(a) determine any dispute; (b) grant interim remedies; (c) grant any other provisional or protective relief.

Changes and Cancellation

Any request for changes must be made in writing by the Client and agreed by PowerSeller.AI. Charges may apply for any changes made to the service after commencement. While every effort will be made to accommodate changes and additional requests, these cannot be guaranteed.

Any order cancelled by the Client after the commencement of a campaign but prior to completion will be charged in full. For cancellation one month written notice is required by email. PowerSeller.AI reserves the right to cancel any campaign at any time, with or without cause.

Data Protection and Privacy

All personal information that the Client provides for the purposes of the provision of services will be held and processed strictly in accordance with our Privacy Policy, which is available on our website. PowerSeller.AI is committed to upholding the principles of data protection and confidentiality, and we implement best practices to secure the data entrusted to us.

Intellectual Property

Unless expressly stated otherwise, all intellectual property rights arising in relation to our website, our services, or the content we create or provide for our Clients, will remain at all times owned by PowerSeller.AI or our licensors. These rights include, but are not limited to, copyright, trademarks, the right to use content, and all other intellectual property rights.

Force Majeure

Neither party will be liable for delay or failure to perform any obligation under this Agreement if the delay or failure is caused by any circumstance beyond their reasonable control, including but not limited to, acts of God, war, civil unrest or industrial dispute.

Miscellaneous

If any provision of this Agreement is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect and enforceable.

No agency, partnership, joint venture, or employment is created as a result of this Agreement, and the Client does not have any authority of any kind to bind PowerSeller.AI in any respect whatsoever.

This Agreement and the interpretation of its terms shall be governed by and construed in accordance with the laws of the jurisdiction where PowerSeller.AI is headquartered and shall be subject to the exclusive jurisdiction of the courts located within the same jurisdiction.

Conclusion

By accessing or using the services provided by PowerSeller.AI, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree to all of these Terms and Conditions, then you may not access or use the services provided by PowerSeller.AI.
